Our Privacy Policy

In order to function properly, the Medisch Laser Centrum processes personal data. This includes both general and health data. According to the AVG law, we need your permission for this.
Who we are

The Medisch Laser Centrum – known to the Chamber of Commerce as Medical Practice for Laser Treatments with Chamber of Commerce number 33263606 – is located at Cornelis Schuytstraat 55, 1071 JG in Amsterdam. The Medisch Laser Centrum is responsible for the collection and use of personal data described in this privacy policy.

GDPR Act

In May 2018, the General Data Protection Regulation (GDPR) came into effect to better protect your personal data. Every company that processes your data (this means: collects and uses it) needs a good reason to do so. In the case of health data, your explicit consent is required in most cases. For us, this means that if we do not have your consent, we are unfortunately not allowed to treat you.

Data about you that we process and for what purpose

General data, obtained via email, telephone, or personal contact. This includes your name, date of birth, address, telephone number, email address and your Citizen Service Number (BSN).

We use this to fulfill the following agreements with you:

  • Contacting you
  • Booking and/or changing an appointment
  • Sending prescriptions to your own pharmacy (only if you need medication)
  • Requesting medication from our pharmacy (the Lairesse Pharmacy in Amsterdam) for you in connection with a treatment.

We also use this information for the following legal obligations:

  • Creating, retrieving and maintaining a personal medical file
  • Recording turnover by means of daily, weekly, monthly and annual reports.

Medical data, filled in by you on your health declaration and obtained by your practitioner during consultation and treatment. Sometimes we also receive this data via a telephone conversation or email contact with you. Medical data includes your medical treatment history, your medication use, complications, complaints and any illnesses and/or conditions.

We use this to comply with treatment agreements with you and to comply with the following legal obligations:

  • Creating, retrieving and maintaining a personal medical file
  • Deciding whether treatment can take place
  • Correctly performing an appropriate treatment

We also use this information to comply with the following legal obligations:

  • Reporting annual reports to the Health and Youth Care Inspectorate (IGJ). This is a legal obligation for us. All your data is anonymized in this case.
  • Policy analyses to continuously improve our clinic. In this case, your data is also anonymized.

Financial data, filled in your file. This contains all your expenses on products and treatments within our clinic.

We use this to make a number of legally required declarations:

  • Tax declarations – your data is anonymised in these
  • Recording turnover by means of daily, weekly, monthly and annual reports.
  • We also need your permission to use this data, after it has been made anonymous, to carry out policy analyses.

Within our clinic we use an electronic file system. This system is provided and maintained by an external party. Because it is necessary for this party to have access to the entire system and therefore also your data, we have made clear agreements. For example, they may only process personal data if we explicitly request it or give permission to do so, for example to repair an error in the system. In that case, only authorized persons may work with personal data.

Apart from the above-mentioned third parties (the Health and Youth Care Inspectorate, your own pharmacy, our pharmacy (the Lairesse Pharmacy in Amsterdam) and our supplier of the electronic file system), your data will only be processed internally.

Your rights

You also have a number of important rights with regard to the personal data we process:

Transfer of data
  • You can obtain a copy of all your data known to us (your file) in a machine-readable format.
Inspection
  • You can view your file and request which personal data we process about you.
Rectification
  • You have the right to have data in your file that is no longer correct changed by us. However, we cannot change medical history such as treatments performed in our clinic at your request.
Restriction of processing
  • You can temporarily suspend the processing of your data.
Objection
  • You can object to the further processing of your data.
Oblivion
  • You have the right to be 'forgotten'. In the case of your medical file, however, we are obliged to keep it for 15 years. In this case, you cannot invoke the right to be forgotten.

By the way, it is important to know that we do not make automated decisions. This means that a person is always involved when a choice is made regarding your data.

Finally, you have the right to file a complaint with the Dutch Data Protection Authority about our processing of your personal data.

Important

Without your consent, we are unfortunately not allowed to treat you. This is because all data that we process is essential for the correct execution of treatments, the obligations that we have towards the state and the functioning of our clinic. However, your consent does not mean that we may share your data with third parties outside of the parties mentioned in this agreement or sell it to third parties. You can also withdraw your consent at any time. This means that we are no longer allowed to process your data and that we are no longer allowed to perform treatments on you. However, in this case too, we are legally obliged to keep your medical file for 15 years.
